Assesment methods:
Student will absolve the exercises and write one test. The maximum number of points for the test is 16. Student will pass the test successfully if he is earned at least 9 points. Student will successfully pass the final oral exam. The maximum number of points for the oral exam is 16. Student will pass the oral exam successfully if he is earned at least 9 points. Student will get credits for the course if he successfully passes both, the written test and oral exam. Student is grade as fallow: A 30 – 32 points; B 27 – 29 points; C 24 – 26 points; D 21 – 23 points; E 18 – 20 points.
Learning outcomes of the course unit:
The student is oriented in the wide range of economic and legal question with and he obtained - like the future economists and businessman - the basic knowledge from mercantile and financial laws. He is acquainted with the legal regulation of economic relations, especially with more detail with the problem of ownership relations. He obtains knowledge about mercantile and trade law and about selected problems of the state, administrative, labour and civil law. The student is able to identify the system of authorities applying the law (judicial and other authorities with the emphasis on the mercantile justice). He obtains the basic orientation in the Slovak law and the basis for the study of legal branches associated with individual specializations.
Course contents:
Subject of the mercantile and financial law.
Commercial and financial organizations and institutions in relation to the international, public, private and mercantile law.
Concept of the business activity within the mercantile law. Natural persons and legal entities. State and municipal enterprises.
The position of entrepreneurial subjects according to the provision of the Commercial and civil code. The legal regulation of their origin, action and extinction.
Economic competition and its protection. The unfair competition.
Ownership relations and the forms of ownership in accordance with the Constitution of the Slovak Republic. The ways of gaining the ownership.
Mercantile and financial commitment relationships, the conclusion of mercantile contracts.
Modes of ensuring commitments, the modes, place and time of fulfilingcommitments.
Breach of contract obligations and its consequences. The compensation of a damage.
Limitation - its subject, effects, suspend and limitation.
Budgetary system, state budget and state final account.
Legal questions of the stock exchange and valuables.
World and European foreign-exchange and credit institutions and organizations, their structure and system of functioning.
